As a user of our online dating photo service, you agree to the following:
Your Eligibility
You must be eighteen or over to use this service. No exceptions. By using the Web Site, you represent that you have the legal capacity to enter into this Agreement and to abide by the terms and conditions of this Agreement. By agreeing to our terms and conditions, you declare that the information that you disclosed on the site is correct and that you agree to pay for our service at the current advertised rate.
Payments
Payment in full is required prior to the photo session, e-Cyrano packages and styling packages. We use SSL encryption, so your order is completely secure.
Location of photo session
If you want to have your photo session taken at a location that requires a photo permit, the responsibility lies on you to obtain the permit in the proper amount of time for your session and also pay for it. Our photographers use areas that are free to photograph.
Outfits need to be approved before photo session
All of our clients will either work with our stylist (for our male clients) or our concierge (for our female clients), unless they hire our stylist Kimmy for an additional cost. Outfits need to be approved prior to your photo session. We require full length selfies so we can see clearly the outfits you will be wearing for your session. We purposely give you a two week advance prior to your photo session to get your outfits in order. We have everything spelled out clearly in our Prepare for your photo session styling sheet for both men and women. You must have everything approved within three days of your photo shoot. If for some reason there needs to be any changes, you still have some time, or you postpone your shoot until everything is ready.
If you choose not to work with our stylists or concierge (and not have anyone on the outside helping you), we cannot guarantee your photo shoot will turn out. Many people don’t realize what styles work best, if their clothes are fitting them properly and if the color works for their skin and hair color. We will not offer you a free reshoot if the photos do not turn out well.
Cancellation & Rescheduling – Photo Sessions
Once you begin consultation with our concierge, there will be a non refundable fee of $150 for this service. This service includes emails, phone calls and maybe a zoom call to assist in your clothing choices or any other questions you may have prior to your photo session.
Cancellation with no rescheduling within 48 hours of photo session
If for some reason you need to cancel your photo shoot, you must contact your photographer within 48 hours of your shoot. There must be actual contact via phone conversation, text or email exchange with your photographer. You will also have to contact LookBetterOnline by emailing [email protected] or during business hours (9-5 EST) call (888) 282-9777 to let us know directly in order to receive a refund for the remaining amount paid minus the $150 administrative fee as described above. .
Cancellation within 24 hours of photo session and then rescheduling for new shoot
If you must cancel your photo session within 24 hours of your shoot, you are still obligated to pay for that shoot as LookBetterOnline.com is responsible to pay the photographer for holding that slot open for you. At such a late notice, that photographer can not refill your time slot.
When rescheduling your new shoot with the photographer, we will offer you a discounted rate for the same package but ask that you pay the photographer directly at the time of the new shoot. Any travel fees required by the photographer will be added at that time too if that had been discussed prior.
The new discounted fees if rescheduling after cancellation within that 24 hour period is $200 for a Classic Session and $250 for a Deluxe Session.
Rescheduling due to weather
LookBetterOnline.com maintains the right to reschedule the session appointment due to rain, snow or a personal emergency of your assigned photographer. Rain policy: should the weather forecast predict a 40% chance (or higher) of any type of precipitation, at least 8 hours prior to your session time, you have the option to reschedule for another date, free of charge. If you choose to continue with the shoot and the outcome is still the same, you will need to arrange with your photographer to continue with the shoot in a covered area or reschedule for the nearest date available to the two of you for the rest of your allotted time in your session. No additional fees will incur. It is the photographer’s responsibility to inform LookBetterOnline.com of any new changes to the photo session and any additional time that will be needed on a new date and time.
Rescheduling due to illness or other unforeseen events by client
You may reschedule your photo session as long as you contact your photographer before 48 hours of your photo session. There must be actual contact via phone conversation, text or email exchange with your photographer. You will receive a credit for your session, to be used within 30 days of the date of your original photo session. Your new shoot must be for a mutually agreed time and date between you and your photographer. It is the photographer’s responsibility to inform LookBetterOnline.com of the new date and time scheduled. It is not LookBetterOnline’s responsibility to remind you, the client, of your 30 day window. If you don’t use the credit during that time, you will forfeit your refund. You are only allowed one rescheduling for a photo shoot.
Photo shoots changed or cancelled by LookBetterOnline
We will make every reasonable effort to provide the services you have purchased with LookBetterOnlin.com. If we must make any changes to your photo session or cancel your confirmed session, we reserve the right to do so if it becomes advisable or necessary. If we must cancel your session, we will either provide a credit towards a new session or refund for the remaining amount paid minus the $150 administrative fee.
Refunds for Photo Session
If you are unhappy with the technical outcome of your photos, we will give you a free reshoot. The reshoot must be taken within 30 days of the original shoot. Any complaint should be communicated in writing to [email protected] within 3 days of the photo shoot. No re-shoots will be entertained for any reason after this period.
Please note this does not apply to issues with your clothing choices, physical appearance, hair, makeup, weather, acts of God, or any other issues that are beyond the control of the photographers of LookBetterOnline. Due to Covid, we may be limited on where photo shoots can take place. In these cases, we will not be able to issue you a refund or re-shoot.
Refunds/Cancellations for Styling Sessions
All purchases of styling programs are final and non-refundable. If after completing a session, you believe did not derive substantial value from the session, we will gladly refund your fee. To claim a refund, please submit a written refund request to [email protected]. In your request, you are required to verify that you completed all instructional material and home assignments in accordance with the instructions provided in the session. To be valid, we must receive your refund request within 180 days of your date of purchase.
Refunds/Cancellations for e-Cyrano
You agree to fill out the online questionnaire as per the instructions of e-Cyrano.com. Should you not fill out the online questionnaire accordingly, e-Cyrano is not legally obligated to assign you a writer. This contract stipulates a certain level of effort on your part and should you fail to meet that level of effort, e-Cyrano does not have to render services. Similarly, e-Cyrano does not offer refunds to those who refuse to follow directions, as writers can’t produce profiles without a considerable amount of information provided by the customer. Like a membership to a gym, you get out what you put in, and should you decide after signing up that you don’t want to use the service immediately, your credit remains in the system for redemption for a period of one year after the purchase date.
Indemnity
You agree to indemnify and hold LookBetterOnline.com, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney’s fees, due to or arising out of your use of the Service.
Liability Limitation
Except in jurisdictions where such provisions are restricted, in no event will LookBetterOnline.com be liable to you or any third person for any indirect, consequential, incidental, special or punitive damages, including lost profits arising from your use of the Web Site or the Service, even if LookBetterOnline.com has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, LookBetterOnline.com’s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to LookBetterOnline.com for the Service during the term of membership.
Email list
Once you’ve purchased any of our services, you are automatically enrolled in our mailing list. We may send you emails from time to time to let you know about new services or to announce a promotion or survey. We will not sell your information to third parties. You may choose to opt-out by emailing us to remove you from the list.
Quality
LookBetterOnline.com will do its best to contract the best portrait photographer for you and get you the best portrait photographs that we can. Although every effort will be made to ensure your satisfaction, individual results may vary.
We do our best to provide quality color corrected, exposed properly images. You get either 12 or 18 (depending on your purchased package) photos ready to use online only. We offer web ready images (1800×1200 pixels) that you can easily upload to your favorite dating site. You may order hi res images separately as well as other products such as retouching, black/white, LinkedIn and square images.
Hi res images may be purchased from your personal online gallery, so you can order prints from any photo lab.
Warranty or Guarantee of Results
User understands and acknowledges that LookBetterOnline.com makes no warranties, representations, nor guarantees, express or implied, as to the outcome or results of dating or interactions using the services of LookBetterOnline.
Agreement
This Agreement contains the entire Terms and Conditions agreement between you and LookBetterOnline.com regarding the use of the Web Site and our service. If any provision of this Agreement is determined to be invalid, the remainder of this Agreement shall continue in full force.
